Joe On Friday, Kansas Democrat Governor Laura Kelly blasted President Joe Biden’s attempt to unilaterally mandate that millions of working Americans get the COVID-19 vaccine. Folks, when a Democrat president loses a Democrat governor, you know your policy belongs in the trash.
The governor’s comments came the day after the White House denounced the mandate for businesses with more than 100 employees. The mandate is being implemented via the Occupational Safety and Health Administration (OSHA), and it discriminates against unvaccinated employees by forcing them to either get the jab or undergo routine COVID-19 testing.
In a statement made on Friday, Kelly denounced the mandate as neither “correct,” nor “effective.”
Yesterday, I reviewed the new vaccine mandate from the Biden Administration. While I appreciate the intention to keep people safe, a goal I share, I don’t believe this directive is the correct, or the most effective, solution for Kansas.
States have been leading the fight against COVID-19 from the start of the pandemic. It is too late to impose a federal standard now that we have already developed systems and strategies that are tailored for our specific needs. I will seek a resolution that continues to recognize the uniqueness of our state and builds on our on-going efforts to combat a once-in-a-century crisis.
Kansas politicians gave bipartisan applause to Kelly’s message.
In fact, Kansas Democrat state Senator Tom Hawk agreed that mandates aren’t as effective as trying to encourage people. Of course, the Biden administration keeps saying that mandates work by looking at the numbers of workers who were coerced to get vaccinated or not be able to feed their children. Mandates end up breeding anger and resentment.
“I think that the governor has pointed out that maybe mandates don’t work as well as some of the things she’s trying to do, which is encouraging people to get the vaccine,” Hawk said, according to WDAF-TV.
“I want people to know that I think getting the vaccine is a critical part of us putting the COVID-19 pandemic in the rearview mirror,” he added, “I think the critical thing is to encourage people to get the vaccine.”
On Saturday, the Fifth Circuit of the US Court of Appeals has issued a stay on Biden’s unlawful vaccine mandate.
“Because the petitions give cause to believe there are grave statutory and constitutional issues with the Mandate, the Mandate is hereby STAYED pending further action by this court,” the three-judge panel wrote. The court cited “grave statutory and constitutional concerns,” with the administration’s mandate, and gave the administration until 5 pm Monday to respond before ruling on a permanent injunction.
The Justice Department responded by pledging to defend the mandate. Lawyers without souls.
“The OSHA emergency temporary standard is a critical tool to keep America’s workplaces safe as we fight our way out of this pandemic,” Justice Department spokesman Anthony Coley said. “The Justice Department will vigorously defend this rule in court.”
The problem for the administration is OSHA is charged with protecting workers from something provided by their employers. For example, employers have to provide protective equipment, such as hard hats, when employees work in an environment that needs them. A virus is not something that is provided by an employer. This is why OSHA implementing the mandate is so ridiculous.
There are so many other problems with the mandate that go beyond the fact that the administration chose to have OSHA enforce it. Things like there is no available vaccine for COVID that was approved by the FDA, so this would be the first time in history, at least since the writing of the Nuremberg Code that the government was mandating an experimental medicine. Federal law says you cannot mandate an experimental vaccine and all three used in the US are still under Emergency Use Authorization (EUA).
On top of that, federal law also says that you cannot mandate a vaccine when there are viable alternative treatments. The Biden administration did their level best to trash therapeutic drugs like ivermectin and hydroxychloroquine, but there are thousands of medical doctors around the world who are reporting that they have successfully treated their COVID patients using these alternative treatments.
